    What is Personal Data?

    Personal data is any information relating to a person (a ‘data subject’) who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.

    What is Considered Processing of Personal Data?

    Processing of personal data means using personal data in any way, including, collecting, storing, analysing, accessing, sharing, transmitting and erasing.

    What is consent?

    Consent is defined as any freely given, specific, informed and unambiguous indication of a person’s wishes by a statement or by a clear affirmative action, signifying agreement to the processing of personal data.

    What is meant by personal information?

    Personal information (data) means all information that can be used to directly or indirectly identify a person. Examples would be name, date of birth, address, tax reference number, email address and also online identifiers such as IP address.

    What is the role of the Data Protection Officer?

    The Data Protection Officer (DPO) is responsible for, among other things, monitoring internal compliance with the Data Protection Act, informing and advising the organisation on data protection obligations, providing advice regarding privacy assessments and acting as a contact point for data subjects and the supervisory authority.

    The Jamaica National Group has appointed a DPO for the Group, who is based in Jamaica.

    Does the JN Group share my information?

    The JN Group treats our customers and members’ personal information as private and confidential and only shares this information if it is legally permitted to do so. We may disclose personal information with affiliated or non-affiliated third parties, who provide services for us that are necessary to meet our contractual obligations to you, or as necessary for the purposes of legitimate interests.

    We will also disclose information, where necessary to comply with any legal obligation to which we are subject, e.g. disclosure to a regulatory body.

    What is expected of companies under the Jamaica Data Protection Act (JDPA)?

    Companies are expected to observe the eight standards for processing personal data under the JDPA:

     

    1. Process personal data fairly and lawfully.
    2. Process personal data in ways that are compatible with the purposes for which it was collected.
    3. Ensure that personal data is adequate, relevant and limited to what is necessary for the purposes for which it is processed.
    4. Ensure that personal data is accurate and up-to-date.
    5. Ensure that personal data is not kept for longer than is necessary and is disposed of as required.
    6. Process personal data in accordance with data subjects’ rights.
    7. Ensure that personal data is protected by appropriate technical/organisational measures and notify the Information Commissioner of any security breach which may affect personal data.
    8. Ensure that personal data is not transferred outside Jamaica without adequate levels of data protection.

    What are my rights under the JDPA?

    The JDPA gives you five rights over your personal data, subject to certain conditions:

    1. Right of access to personal data
    2. Right to consent to processing
    3. Right to prevent processing
    4. Rights in relation to Automated Decision making
    5. Right to rectification

    How long does the JN Group keep my information?

    We will keep your information for as long as you have an account with us, and thereafter, for the amount of time required to satisfy any legal obligation to retain records.
